Terms and Conditions of Booking (“Ts+Cs”)

We are delighted that you have chosen to book your holiday with Extreme-Safari.  Below are the terms and conditions which govern the agreement between you and Extreme-Safari.

Booking

You book your Extreme-Safari as follows:

1.      Plan your Trip using our on-line form available at www.extreme-safari.com/plantrip.html. Send this to us at info@extreme-safari.com  

2.      We prepare a detailed Quote which we feel suits your stated requirements (usually within 48 hours).  We will send you an email with a detailed itinerary.  We will also provide you with a Reference number. 

3.      Provided you are happy you can email us to confirm the trip. Alternatively we will work together to amend any of the details of your trip, and we will prepare a revised Quote. 

4.      On receipt of notification of your acceptance of the Quote and receipt of full payment for the Trip, both you and we agree to be bound by the terms of these Ts+Cs and you also agree to be bound by the terms and conditions of the relevant Partner where applicable.  Once accepted the Quote and the details of the Trip may only be amended with our prior written consent.  There may be a charge for any such changes and any changes to the Trip itinerary may require a revision of the Quote.

 

Note that all booking are subject to availability and confirmation and rates/availability are not confirmed until we receive payment in full or a deposit.

Payment

Payment will be made in full at time of acceptance of the Quote by bank transfer in Pounds Sterling or cheque in cleared funds.

For certain trips where the departure date is more than 45 days after the date of a confirmed booking, we will accept payment of 50% of the holiday cost by way of a deposit with the balance payable at least 45 days before the date of travel - your invoice will set out the due dates.  Please refer to our cancellation and refunds terms below.

You will be responsible for paying any relevant taxes, VAT, charges and levies – these will be detailed in the Quote and/or Invoice.

Payment for the Trip will be made in Pounds Sterling, unless otherwise agreed and will be made by bank transfer or cheque in cleared funds, cash or such other mode of payment as is agreed between the parties. 

You will receive an email confirming receipt of payment.

Game Park and Conservancy Fees

All game parks and private concessions/conservancies in East Africa charge entry fees.  We will advise you of these fees at the date of booking.  Ordinarily these will be included in the cost of your trip.  If park fees are payable by you on arrival then we will advise you of this and it will be clearly stipulated in your Itinerary.  Park fees are payable in cash.  NOTE that park fees may be increased at any time at the discretion of the relevant wildlife service, government, town/municipal or district council or local landowners.  We do not have any control over such increases and (in the event of such increase) you may be required to pay the difference between the park fees you have paid to us and the park fees in force as at your date of entry to the relevant park and private concession/conservancy.  We will make reasonable efforts to inform you of any such increase.

Agent Only

Extreme-Safari operates as a sales agent on behalf of our Partners.  For your protection and in accordance with the Civil Aviation (Air Travel Organisers Licensing) Regulations 1995 (ATOL), for all flight bookings our Partners are ATOL licence holders.  Our Partner travel agency, Going Places Kenya Limited, is IATA Accredited and are authorised to sell and issue international airline tickets.  In the case of ATOL and non-ATOL services we will provide you with an ATOL and a non-ATOL receipt/invoice, the latter covering goods and services provided by Partners who are not ATOL licence holders.  As we act as agent for our Partners you will have a direct contractual relationship with our Partners in relation to the products or services provided by them.  We have full authority to bind our Partners contractually and upon your acceptance of the Quote our Partners have a contractual obligation to provide to you the services set out in the Quote.  In accepting these Ts+Cs you accept that the provision to you of products or services (including activities, flights, transfers, accommodation, insurances and so forth) by such Partners (ATOL and non-ATOL) is exclusively governed by the terms and conditions of such Partners.  The terms and conditions of our Partners will be made available to you at time of booking or will be brought to your attention prior to the activity, as applicable.  Unless specifically set out in these Ts+Cs, Extreme-Safari accepts no responsibility for any acts or omissions of, or loss or damage caused by, our Partners.  However we undertake to use our reasonable endeavours to assist you in resolving any disputes you may have with our Partners.

 

Passports

Certain countries require citizens to hold a valid 10 year passport for travel outside their county of residence or birth.  Certain countries may require at least 6 months validity remaining on the passport on the date of return.  Please check with your local passport agency or the relevant embassy/high commission for all applicable rules

 

Visas + Health

Visas may be required for entry to certain countries.  We will make reasonable endeavours to inform you of any Visa requirements but it is your responsibility to ensure that you and your group comply with all applicable immigration, visa and entry restrictions or requirements.  You should contact the embassy, high commission or consulate of the destination(s) for up-to-date advice on immigration, visa and entry restrictions or requirements. 

Likewise you should ensure that you have all necessary vaccination and inoculations before travelling to your destination.  We will make reasonable endeavours to inform you of any such requirements but it is your responsibility to ensure that you and your group take all reasonable precautions.  You should contact your doctor or local health and travel advisory service, the embassy, high commission or consulate of the destination(s) for up-to-date advice on health risks, vaccination, inoculations and prophylaxis. 

 

Flights and Carriage of Sports Equipment

Domestic and international flights are arranged for you by our IATA or ATOL affiliated Partners.  We will endeavour to find the most competitive fares available and may recommend deferring or advancing your departure dates to take advantage of lower fares.  Sports equipment (such as windsurf and kitesurf equipment, mountain bikes, scuba gear and golf clubs) can be carried with you subject to the relevant airline’s capacity restraints and terms of carriage.  Most scheduled airlines have specific allowances for sports equipment but they may levy extra charges (be it per-kilo or per-item).  We will make all reasonable endeavours to get confirmation of the airline’s policy prior to travel but are not liable for any additional charges levied or any refusal to grant carriage.

 

Cancellation and Refunds

The right to a refund in the event of cancellation will depend upon the terms and conditions of our Partners.  In the case of flights, for example, depending upon the fare class, you may not have the right to a refund on cancellation or change and strongly recommend that you take out appropriate insurance.  In the case of certain activities you may have the right to a partial or total refund provided you give us notice in writing of any change or cancellation reasonably in advance of travel – again this right will be set out in the terms and conditions of the relevant Partner or my be granted at the relevant Partner’s discretion.  In all cases you will have to pay a small administration fee.

Unless otherwise stated, our standard refund terms are as follows (note this does not apply to airline tickets which may not be refundable once issued):

Cancellation terms – 90% refund if within 45 days of booking provided this is at least 3 months before departure, 50% if within 3 months of departure, 0% if within 1 month of departure. Other terms and conditions may apply and will be indicated at time of booking.
Airline tickets may be non-cancellable, non-changeable and subject to additional terms.

(Dates listed are from date of departure from home country).

Note that for Diani House cancellation within 60 days only 50% will be refunded.

Insurance

We strongly recommend that you take out appropriate insurance to cover you in the event of cancellation, delay, illness, loss or damage to personal property, and so forth.  Extreme-Safari can provide a list of insurers for travel in Africa and insurance for extreme sports activities if required.  NOTE that we cannot make any form of recommendation nor provide guidance on the contents or suitability of a particular policy.

Our Partners carry appropriate civil liability insurance as required under the law of the country in which they operate.  Details of such insurance policies are available on reasonable request.

 

Times

All times are based on the 24 hour clock and are local.  For example if your flight times are shown as dep. Nairobi 08:45 arr. London 13:45 then the departure time is local time Nairobi (+3 GMT) and arrival time is local time London (GMT) (with allowance for Daylight Saving as appropriate).

 

Changes to Itinerary/Activity

In certain circumstance it may be necessary for us to vary an element of your Trip due to circumstances beyond our control (i.e. rainfall, flooding, government restrictions, etc).  We may, for example need to vary the order in which you do certain activities or use another Partner or another location for the chosen activity.  In this event we will endeavour to minimise any disruption and provide at least the same level and quality of service previously offered.

 

Force Majeure

In the event of circumstances beyond the control of either party or that of our Partners (Force Majeure Events) we reserve the right to postpone, alter or even cancel your Trip or an element of your Trip.  Force Majeure Events include, without limitation, fire, flood, civil unrest, coup, acts of terrorism, strikes, national emergency, disease epidemics, famine, drought, and so forth.  We will make reasonable endeavours to minimise any disruption to your trip by providing alternative transport, accommodation or activities wherever possible.  Your remedy in the case of a Force Majeure Event will be governed by the terms and conditions of the relevant Partner(s) and we will use our reasonable endeavours to assist you in your communications with our Partners.

 

Website and Brochures

Extreme-Safari is constantly evolving and we add new activities and improve on existing ones on a regular basis. Accordingly our websites and brochures and the details and costs of anything contained therein may be subject to change.  Where applicable we will notify you of any changes prior to acceptance of any Quote.

 

Entire Agreement and Priority

These Ts+Cs and the accepted Quote represent the entire agreement between us.  Unless specifically stated as being included in the Quote, any additional activities or excursions may incur additional charges. Any other information (including brochures, websites, and so on) and any other communication, whether transferred electronically, in writing or orally, is hereby excluded.  The agreement between us may only be amended by written agreement between us. These Ts+Cs shall take precedence over the Quote in the event of any disparity between them.

 

Liability

Extreme-Safari takes pride in selecting its Partners on the basis of their professionalism, level of customer care, safety record and consideration for the eco-system in which they operate. However given that we act solely as sales agent on behalf of our Partners and IATA or ATOL protected operators, to the extent permitted by law,  we do not accept any liability for loss, damage, death or personal injury resulting from any products or services provided by them.

 

Data Protection

We will control any personal data that you provide to us in accordance with the Data Protection Act 1999 and undertake not to release your data to third parties without your prior consent.  We reserve the right to share your personal data with our Partners where necessary for the provision of the Services.

 

Governing Law

These Ts+Cs will be governed by and construed in accordance with English law and the Courts of England and Wales will have exclusive jurisdiction over any disputes arising hereunder.

 

Definitions

Extreme-Safari”, “us” or “we” refers to Extreme-Safari Ltd

“You” refers to the person making the Booking with us and by Accepting our Quote and making Payment you warrant that you have authority to bind any other passengers listed on your Booking Form for the Trip.

Trip” means the trip you have booked with us and which is set out on the Quote.

Partners” means our 3rd party suppliers.  For the avoidance of doubt we act as agent on behalf of our 3rd party suppliers, they are not ‘partners’ under operation of English law and we are not joint and severally liable for the acts and/or omissions of the other.

Quote” means the quote which we provide to you based on your stated requirements.  The Quote will include, amongst other things, the price of the trip, the number of travellers, the activities you have booked, the dates and method of travel and so on.

Booking Form” means the booking form.
